The model-order rule and the two versions

For domestic relations orders entered by a court on or after January 1, 2015, TRS says the parties are required to use its model order. The system provides one model for a participant who is not retired as of the divorce date and another for a participant whose TRS retirement date is before the divorce.

The model is not a do-it-yourself promise that a particular division is legally correct. TRS describes it as an administrable form and expressly notes that it does not replace legal advice. The court still determines the award. From a records perspective, the useful distinction is simple: an active-member order deals with benefits that may become payable later, while the retiree model addresses a benefit already in payment status.

Check the record before anyone calculates a share

Before treating a percentage in a settlement draft as a finished pension calculation, identify the member name and TRS status, the dates relevant to the marriage and divorce, and whether retirement has already begun. Then compare the proposed court language with the current TRS model. The system can explain its forms and benefit procedures, but it does not decide the spouses’ property rights.

If the pension is being divided, keep the court order process separate from beneficiary maintenance. TRS explains that receipt of a certified divorce decree can affect a former spouse’s status for some death benefits, while it does not automatically change a beneficiary for a continuing optional retirement annuity. That distinction is easy to miss when reviewing a divorce file.

What TRS needs after the judge signs the order

When an interest in TRS retirement benefits has been awarded, TRS says a certified domestic relations order is needed for its review. The certified order must come from the clerk of the court and include the judge’s signature. TRS specifically distinguishes a true certified copy from a file-stamped, conformed, faxed, or emailed copy. The system’s current instructions direct the certified DRO to TRS for qualification review rather than treating a signed settlement agreement in a private file as enough to trigger direct payment.

TRS also explains that a certified divorce decree is not required for approval of the DRO itself when the retirement plan benefit is being divided. If a decree purports to divide the pension but is sent in place of the required TRS model order, TRS may reject the decree as a QDRO and ask for the model domestic relations order.

When an alternate payee can actually be paid

A QDRO does not generally create an immediate cash-out. TRS administers the award when benefits become payable under the plan. Its review guidance describes a limited exception under which an alternate payee may receive payment before the participant starts payments when the participant is at least age 62 and is otherwise eligible to retire without an early-age reduction.

If TRS finds the order unqualified, it notifies the parties and identifies the basis for that determination. A revised order can later be submitted, but TRS warns that payments made before a corrected order becomes qualified are not retroactively recreated by the system. For example, if a benefit or distribution has already been fully paid before TRS receives an acceptable revised order, TRS may be unable to pay part of that completed distribution to the former spouse.

Beneficiary elections are a separate post-divorce check

Property division is not the end of the TRS account review. TRS says a divorce does not by itself automatically revoke a former spouse as beneficiary of death benefits; the system must receive the certified divorce decree before the death benefit is paid for the decree to have the stated revocation effect. If the participant wants the former spouse to remain the beneficiary, TRS recommends completing a new beneficiary designation so the current intention is clear in the system’s records.

Continuing optional retirement annuities have different rules. TRS explains that receiving a certified divorce decree does not itself revoke a former spouse as beneficiary under Options 1, 2, 3, 4, or 5. A retiree seeking a permitted change must use the applicable TRS process, and some options require consent or specific court authorization. Because property division, death-benefit designation, and optional-annuity beneficiary status can move on different tracks, confirm each one separately rather than assuming a single divorce filing updated all three.
