A divorce agreement alone does not tell TRS how to divide the pension

New York treats retirement benefits earned during a marriage as marital property that can be addressed in equitable distribution, but NYC TRS does not automatically split an account because a couple divorces. Its current Guide to Domestic Relations Orders says a court-issued DRO must contain the pension terms that TRS can administer. A judgment of divorce or separation agreement by itself is not a substitute for that order when the parties want TRS to divide a Qualified Pension Plan benefit.

The terminology deserves care. TRS is a governmental plan and says it is not subject to ERISA’s Qualified Domestic Relations Order provisions. Older materials and payment screens may still use “QDRO” as a familiar label, but the current legal-process guide is built around a DRO. For a public guide, the safer description is therefore “Domestic Relations Order reviewed by NYC TRS,” with the member and former spouse using counsel for the actual matrimonial drafting.

Submit an unsigned draft before asking the court to sign it

TRS describes a four-step workflow: prepare an unsigned draft, send it to TRS with identifying information for the Alternate Payee, receive TRS feedback on whether the terms are administrable, and then obtain the court signature before sending TRS a court-certified copy. The Model DRO in the guide can be used as a starting point but is not mandatory. Skipping draft review can create another court trip if the signed order directs TRS to do something the plan cannot implement.

A draft does not freeze the member’s account. TRS specifically warns that preparing or submitting a draft DRO does not stop the member from retiring, borrowing, or withdrawing merely because a divorce is pending. Restrictions may be imposed after TRS receives an administrable signed DRO if its terms require them. That timing issue makes account information and filing status important whenever the marital settlement assumes a balance or pension feature will remain unchanged until the order is finalized.

QPP monthly payments and TDA account awards follow different mechanics

For QPP benefits, the DRO can state a dollar amount, a percentage, or a percentage calculated with the Majauskas formula. TRS says QPP payments to the Alternate Payee generally begin when the member retires or when TRS processes the signed DRO, whichever is later. TRS cannot create a separate-interest pension that lets the former spouse choose an independent retirement date, and it cannot force the member to retire by a date written into the order.

The TDA side can move sooner. After an approved DRO, an Alternate Payee generally takes the awarded TDA distribution even if the member is still working, with rollover instructions commonly supplied on form LE25. TRS estimates about 30 to 60 calendar days after it receives rollover instructions, partly because some assets are valued monthly. Treating the QPP pension and TDA account as one undifferentiated “pension” can therefore produce the wrong payment timing.

Choose a division method that TRS can actually administer

TRS does not prescribe a single QPP division formula. Its guide permits a fixed monthly dollar amount, a stated percentage of the pension, or a percentage calculated through the Majauskas formula. That flexibility is useful, but it also means the divorce settlement should say what happens to service purchased later, COLAs, loans, survivor options, and any retroactive amount rather than assuming the system will fill gaps with a default rule favorable to either party.

The Majauskas method is based on a marital-service fraction and is familiar in New York public pensions, yet TRS’ guide explains that service purchases can complicate the numerator. Service both rendered and purchased within the specified marital dates may be treated differently from service purchased later. Parties can override default treatment by writing a specific numerator into the DRO, which is one reason a generic formula copied from another pension system can be dangerous.

Protect the timeline by separating draft review from the signed-order stage

An unsigned draft is the best point to catch implementation problems. TRS asks for the Alternate Payee’s full name, Social Security number, and date of birth with the draft submission, then responds whether the language can be administered. A member authorization used to release account information is considered outdated after 12 months, while a judge-signed subpoena is an alternate information route for a former spouse who cannot obtain a current authorization.

Once TRS approves the draft, the parties obtain the court signature and send a court-certified copy back to TRS. Only after receiving the signed DRO does TRS implement terms and, when appropriate, place account restrictions. A letter saying a divorce is pending does not create those restrictions. The process therefore has a documentation gap in which the member’s account remains active, an operational detail that should be discussed with matrimonial counsel before relying on a future balance.

Treat QPP, TDA, COLA, and survivor rights as separate drafting branches

A QPP pension award and a TDA award can have different distribution dates. QPP payments to an Alternate Payee generally wait for the member’s retirement and are monthly; TDA awards generally must be distributed after the DRO is approved and may be rolled to a qualified account, with TRS estimating 30 to 60 days after rollover instructions.

Survivor rights do not arise automatically from former-spouse status. TRS says rights given to an ex-spouse must be explicit because ERISA spousal protections do not apply to the governmental plan. Retirement-option timing matters too: the ordinary ability to change a payment option generally closes 30 days after the payability date, with a limited Tier I/II exception described in the DRO guide. A divorce order drafted after retirement therefore faces constraints that did not exist before the election became final.
